    What Types of Damages Can I Get After a Car Accident?

    Medical Expenses

    Car accident injuries range from minor things like cuts and bruises to very serious injuries like traumatic brain injuries or paralysis.  Some physical injuries may worsen over time and may require extensive treatment down the road. It’s very important to seek medical treatment as soon as possible after the accident if you think you might have injuries.

    Expenses for medical care related to a car accident can include:

    • Physical therapy or other ongoing health care

    Lost Wages

    The bodily injuries that car accident victims experience can potentially deprive the spouse of the victim of the ability to show affection, including sexual activity.  Loss of consortium damages are a type of personal injury claim that is made by the accident victim’s spouse. A spouse cannot claim loss of consortium damages unless the injury victim recovers damages for his or her injuries.

    Wrongful Death

    If your loved one died as a result of a car accident, you may have a claim for wrongful death.  These damages generally include medical costs, funeral bills, pain and suffering, and loss of enjoyment of life that your loved one experienced before his or her death.

    Punitive Damages

    In some cases, the actions of the at fault driver are so reprehensible, that punitive damages can be awarded.  These damages are completely different from compensatory damages or general damages which are meant to make the victim whole.  Punitive damages are meant to punish a defendant who is guilty of appalling conduct. In the context of a car or truck accident, this might happen if the other driver was under the influence of drugs or alcohol.
