    The REAL ID Act

Congress passed the REAL ID Act in 2005. President George W. Bush signed the REAL ID Act into law on May 11, 2005. The original text for the REAL ID Act can be found in Emergency Supplemental Appropriations Act for Defense, the Global War on Terror, and Tsunami Relief, 2005, P.L. 109-13, §§ 201-207, 119 Stat. 231, 312-16 (2005).

According to the U.S. Department of Homeland Security, the REAL ID Act:

    • Establishes minimum security standards for license issuance and production and prohibits Federal agencies from accepting for certain purposes driver’s licenses and identification cards from states not meeting the Act’s minimum standards.

The purposes covered by the REAL ID Act are:

    • Accessing Federal facilities
    • Entering nuclear power plants
    • Boarding federally regulated commercial aircraft

    Boarding Federally Regulated Commercial Aircraft

If you plan to board a plane in the United States, you must show valid identification at the airport checkpoint. Beginning May 3, 2023, if you plan to use your state-issued ID or license to fly within the U.S., it must be REAL ID compliant. May 3, 2023, is the new REAL ID deadline.

Other valid forms of identification include the following:

    • S. passport
    • S. passport card
    • DHS trusted traveler cards (Global Entry, NEXUS, SENTRI, FAST)
    • S. Department of Defense ID, including IDs issued to dependents
    • Permanent resident card
    • Border crossing card
    • State-issued Enhanced Driver’s License
    • Federally recognized, tribal-issued photo ID
    • HSPD-12 PIV card
    • Foreign government-issued passport
    • Canadian provincial driver’s license or Indian and Northern Affairs Canada card
    • Transportation worker identification credential
    • S. Citizenship and Immigration Services Employment Authorization Card (I-766)

    Check for the Star

You can also check your driver’s license to see if it is REAL ID compliant. If you are unsure, check with your Department of Motor Vehicles. Checking your driver’s license is simple, just check for the star. REAL ID-compliant cards have a star in the upper portion of the card. Look for one of the following:

    • Gold star
    • Black star
    • Star cutout in gold circle
    • Star cutout in black circle
    • Star cutout in gold grizzly bear

Does your Nevada driver’s license have a gold star in the upper right corner? If it does, you already have a REAL ID.
