NHTSA Recall Process
As discussed above, the NHTSA can issue a recall. However, there is a process that generally occurs prior to the NHTSA issuing a recall. You, the consumer, play a very important role in the process. The NHTSA recall process involves the following four steps.
1. Consumer Complaint
The first step in the process is when you, the consumer, report your problem to the NHTSA. You do this by filing a vehicle safety complaint. A complaint can be filed by doing either of the following:
- Contacting the U.S. Department of Transportation’s (DOT) Vehicle Safety Hotline
- Going to the NHTSA vehicle safety website
If the NHTSA receives a number of similar reports about the same product or issue, an investigation may be opened.
2. NHTSA Investigation
The NHTSA reviews filed complaints from vehicle owners and other information related to alleged defects to decide whether to open an investigation. If the NHTSA denies a petition calling for a defect investigation, it will publish its reasons. If the NHTSA decides to open an investigation of alleged safety defects, the investigation is only closed after the NHTSA either:
- Notifies the manufacturer of recall recommendations
- Fails to identify a safety-related defect
3. Recall
As discussed above, the NHTSA or the manufacturer issues a recall if either determines that a vehicle or equipment either:

- Fails to meet a minimum safety standard
4. Recall Management
